For participation in 50 Corridor TMA events

1. In consideration of my participation or my child’s participation in the 50 Corridor TMA event (which may include bike repairs, bike rides, ebike test rides, bike rodeos, or any other event that will be referred to as the ‘Activity’ herein), I hereby waive and release any and all claims of negligence causing damages, including death, personal injury, or property damage which may occur as a result of the negligence of the 50 Corridor TMA, its agents or independent contractors, or my or my child’s participation in this Activity. The 50 Corridor TMA and its affiliates will not pay for medical expenses, lost wages, pain, distress, property damage, or any other damages. This release is intended to discharge in advance the 50 Corridor TMA, the sponsors, volunteers, independent contractor mechanics, anyone contributing services, as well as any other person connected with the Activity, their heirs, executors, successors, administrators and assigns for any and all liability for negligence arising out of or connected in any way with participation in this Activity.

2. I FULLY UNDERSTAND that: (a) BICYCLING ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own or my child’s own actions, or inactions, the actions or inactions of others participating in the Activity, the condition or location in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES"; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my or my child’s participation in the Activity.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE the 50 Corridor TMA, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

BY SIGNING BELOW I CERTIFY THAT I AM 18 YEARS OF AGE OR OLDER, I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND HAVE AGREED FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

I ALSO CERTIFY THAT I OR MY CHILD WILL WEAR A PROPERLY FITTED HELMET FOR ANY ACTIVITY THAT INVOLVES RIDING A BICYCLE.

I hereby grant the 50 Corridor TMA permission to use photographs and/or videos of me taken at their events in web-based publications, print advertisements, and any other marketing or promotional materials.

I hereby affirm that such release to the 50 Corridor TMA does not constitute any form of compensation, including royalties arising from the photographs or videos, to my benefit. I understand and agree that photographs and video in the possession of the TMA shall become the property of the TMA. The use and publication of the photographs and videos however, shall conform to my rights as a subject of said photographs and/or videos.

I hereby waive my right to inspect or approve the photographs and/or videos by which my likeness appears.

I hereby hold harmless, release, and forever discharge the 50 Corridor TMA from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
